1. Introduction

These Terms and Conditions ("Terms") govern your use of PDG Mail ("Service"), operated by PDG Global Limited ("Company", "we", "us", or "our"), a company incorporated in Hong Kong. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Definitions and Interpretation

In these Terms, unless the context otherwise requires:

  • "Service" means PDG Mail's secure email services and all associated features operated by PDG Global Limited
  • "User", "you", or "your" means any individual or entity using the Service
  • "Content" means any data, information, or material transmitted through the Service
  • "PGP" means Pretty Good Privacy encryption
  • "TLS" means Transport Layer Security
  • "Personal Data" has the meaning given in the Personal Data (Privacy) Ordinance
  • "Force Majeure Event" means any event beyond our reasonable control
  • "Hong Kong" means the Hong Kong Special Administrative Region of the People's Republic of China

3. Service Description

PDG Mail, operated by PDG Global Limited, provides secure email services with the following features:

  • End-to-end encryption using Curve25519
  • Transport Layer Security (TLS 1.3)
  • Zero-knowledge architecture
  • Secure email hosting in Hong Kong
  • Private DNS infrastructure

Service Plans:

  • Base Plan: 20GB storage, 5 custom domains, unlimited email aliases
  • Standard Plan: 50GB storage, 10 custom domains, unlimited email aliases
  • Enterprise Plan: 100GB storage, 30 custom domains, unlimited email aliases

All plans include:

  • End-to-end encryption
  • At-rest encryption
  • DNS server access
  • 24/7 technical support
  • 99.9% uptime guarantee

4. Jurisdiction and Legal Framework

PDG Global Limited is incorporated in Hong Kong and operates under Hong Kong's robust legal framework, including but not limited to:

As a Hong Kong-based company, PDG Global Limited is not subject to foreign surveillance laws or data sharing agreements such as:

  • Five Eyes intelligence sharing agreements
  • EU-US Privacy Shield
  • US Cloud Act

5. Data Privacy and Security

Our zero-knowledge architecture ensures:

  • PDG Global Limited cannot access, read, or decrypt your email content
  • Your private keys remain exclusively in your control
  • All email data is encrypted end-to-end
  • Connection logs are deleted every 7 days

The only data PDG Global Limited stores and can access is your account information:

  • Name and contact information provided during signup
  • Billing information for paid services
  • Account settings and preferences

6. Payment and Billing

PDG Global Limited's billing structure operates as follows:

  • All active accounts are billed in full on the first day of each month for the upcoming month
  • New accounts created mid-month are billed at midnight the following morning, pro-rated to align with the first of the month billing cycle
  • Plan upgrades are allowed once every 30 days and are billed on a pro-rated basis
  • Plan downgrades are allowed once every 30 days, take effect immediately, and no refunds or credits will be applied
  • All payments are due immediately upon billing

Payment Methods:

  • Credit card
  • Debit card
  • Other payment methods as specified on our website

Non-Payment and Service Suspension:

  • Accounts with failed payments will be suspended after 7 days of non-payment
  • If an account remains unpaid for 30 consecutive days, PDG Global Limited reserves the right to terminate the account
  • Terminated accounts will have ALL data permanently removed and cannot be restored under any circumstances
  • Reactivation of suspended accounts requires payment of all outstanding balances

Refund Policy:

  • No refunds are provided for partial months of service
  • No refunds are provided for plan downgrades
  • No refunds are provided for plan upgrades - customers are charged the pro-rated difference for the new plan
  • All payments are final and non-refundable

7. Data Responsibility and Backups

Data Management and Backup:

  • Customers are solely responsible for their data and must maintain their own backup solutions
  • PDG Global Limited does not provide backup services for customer data
  • Customers must ensure they have appropriate backup plans and procedures in place
  • While PDG Global Limited implements robust data protection measures, customers should not rely solely on our systems for data preservation

Service Reliability:

  • PDG Global Limited makes every reasonable effort to ensure service reliability and data integrity
  • However, we cannot guarantee 100% service availability or data preservation
  • Customers should implement appropriate redundancy and backup strategies for critical data
  • PDG Global Limited is not liable for any data loss, regardless of the cause

8. Service Limitations and Availability

Service Availability:

  • PDG Global Limited strives for 99.9% uptime
  • Maintenance windows will be announced in advance
  • Emergency maintenance may occur without notice

PDG Global Limited reserves the right to:

  • Perform maintenance and updates
  • Modify or discontinue services
  • Limit access when necessary

9. User Responsibilities and Acceptable Use

Users are responsible for:

  • Maintaining account security and confidentiality
  • All activities under their account
  • Reporting unauthorized access immediately
  • Complying with applicable laws

Users shall not:

  • Use the Service for illegal purposes
  • Attempt to circumvent security measures
  • Interfere with other users' use of the Service
  • Transmit malicious code or spam

Consequences of Breach:

  • PDG Global Limited reserves the right to immediately terminate any account found to be in breach of these Terms
  • Termination may occur without prior notice
  • Upon termination, all account data will be permanently removed and cannot be recovered
  • No refunds will be provided for terminated accounts
  • PDG Global Limited may report illegal activities to relevant authorities

10. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PDG GLOBAL LIMITED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PDG Global Limited does not warrant that:

  • The Service will be uninterrupted or error-free
  • Any defects in the Service will be corrected
  • The Service will meet your specific requirements
  • The Service will be available at any particular time or location

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PDG GLOBAL LIMITED, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use or alteration of your transmissions or content

12. Indemnification

You agree to defend, indemnify, and hold harmless PDG Global Limited and its licensees, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

You agree that any legal action or proceeding relating to these Terms or your use of the Service shall be instituted in the courts of Hong Kong. You agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.

14. Force Majeure

PDG Global Limited shall not be liable for any failure to perform its obligations under these Terms where such failure is a result of acts of nature, government actions, war, civil disturbance, or other causes beyond its reasonable control.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

16. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without PDG Global Limited's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. PDG Global Limited may assign or transfer these Terms, at its sole discretion, without restriction.

17. Waiver

PDG Global Limited's failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of PDG Global Limited.

18. Entire Agreement

These Terms constitute the entire agreement between you and PDG Global Limited regarding the Service, and supersede and replace any prior agreements we might have between us regarding the Service.

19. Changes to Terms

PDG Global Limited reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at PDG Global Limited's sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
